Moskowitz, Democrats in Congress File Amicus Brief Asking for an Appeals Court to Stay a Texas Court’s Ruling Suspending the FDA’s Approval of Mifepristone

WASHINGTON, DC – On Apr 11, 2023, Congressman Jared Moskowitz (D-Florida) and 239 of his democratic colleagues in Congress filed an amicus brief that seeks to protect access to the nation’s most commonly used abortion pill, after a Texas federal judge’s ruling on Friday put the drug in limbo.

As a result of the Supreme Court’s devastating decision in Dobbs last year, nearly 22 million women live in states where abortion is now unavailable. This decision from the Texas federal judge in the case Alliance for Hippocratic Medicine v. FDA could only compound this crisis by further restricting access to abortion medication nationwide. Furthermore, invalidating FDA’s ability to make scientifically sound approvals through this decision further limits the ability of pregnant women to access medical care and safe reproductive choices.

The future of Mifepristone, which is used for both abortions and treating miscarriages, is now uncertain because of this ruling from the Texas federal judge.

“We cannot allow a woman’s right to choose to be trampled by this extreme ruling,” said Moskowitz. “We are already seeing the dangers of the Dobbs decision from last year.”
